A bipartisan coalition of 19 states and the District of Columbia has launched a legal challenge against the U.S. Department of Health and Human Services (HHS), arguing that recent efforts to restrict gender-affirming care for transgender minors exceed federal authority and jeopardize access to medically necessary treatment. The complaint was filed in U.S. District Court in Eugene, Oregon, targeting an HHS declaration that labels puberty blockers, hormone therapy and related procedures as unsafe for children.
States vs. Federal Action on Gender-Affirming Care
In their lawsuit, the coalition asserts that the HHS declaration—issued by Secretary Robert F. Kennedy Jr. and the department’s inspector general—mischaracterizes accepted medical practices and lacks legal legitimacy. The declaration warns that healthcare providers offering gender-affirming treatments to minors could be excluded from federal health programs like Medicaid and Medicare.
Attorney General Letitia James of New York, leading the challenge, argues that federal law requires a formal rulemaking process, including public notice and comment, before such major policy shifts can take effect. According to the states, HHS bypassed these procedural safeguards, making the directive unlawful.
Medical Community and Policy Debate
The administration’s position is based in part on its own internal review promoting behavioral therapy over broad medical interventions for gender dysphoria in youth—a stance that has drawn sharp criticism from major health organizations. Groups such as the American Medical Association and other pediatric associations continue to support individualized, evidence-based gender-affirming care and oppose sweeping federal restrictions.
Meanwhile, HHS has also floated additional proposed regulations that could cut federal funding for hospitals offering gender-affirming care to minors, though these measures are still in the public comment phase and not yet binding.
Ongoing National Controversy Over Transgender Youth Rights
The lawsuit comes amid broader national debates and legal battles over access to transgender healthcare. More than two dozen states have enacted laws limiting or banning gender-affirming care for minors, and courts have been frequently involved in adjudicating those restrictions. Recent high-profile decisions and proposed federal rules have deepened divisions between state and federal authority on health policy for transgender youth.
