Philippines Confirms ICC Warrant Can Be Executed Against Dela Rosa

The Philippine government has stated that law enforcement agencies are authorized to carry out the arrest of Senator Ronald “Bato” Dela Rosa after an International Criminal Court (ICC) warrant linked to alleged crimes against humanity became enforceable.

Justice officials said the warrant remains valid and executable despite ongoing legal and political debates surrounding the ICC’s jurisdiction in the Philippines. The announcement came shortly after the country’s Supreme Court declined to immediately block authorities from implementing the arrest order.

Dela Rosa, a former national police chief and one of the key figures associated with former President Rodrigo Duterte’s anti-drug campaign, has repeatedly denied any involvement in unlawful killings and has questioned the ICC’s authority over the country.

Court Decision Removes Immediate Obstacle to Arrest

The latest development follows a Supreme Court decision that rejected a request seeking temporary protection from arrest. With no restraining order in place, authorities now have the legal basis to move forward if they locate the senator.

Government officials emphasized that law enforcement agencies are expected to follow constitutional procedures and due process while carrying out any operation related to the warrant.

The senator’s whereabouts have remained uncertain in recent days, fueling speculation about whether he may attempt to avoid detention while legal challenges continue.

ICC Investigation Tied to Duterte’s Drug War

The arrest warrant stems from the ICC’s investigation into thousands of deaths connected to the Philippines’ anti-drug campaign conducted during Rodrigo Duterte’s administration between 2016 and 2022.

Prosecutors allege that senior officials played roles in policies that led to widespread killings during anti-narcotics operations. Dela Rosa served as chief of the Philippine National Police during the height of the campaign and has been identified as one of the individuals under investigation.

The senator has consistently denied accusations of crimes against humanity and maintains that security operations were conducted within the law.

Political Tensions Continue to Rise

The case has intensified political divisions in the Philippines, particularly among supporters of the Duterte political camp and the administration of President Ferdinand Marcos Jr.

Authorities have warned that anyone attempting to help a wanted individual evade arrest could face legal consequences. Meanwhile, supporters of Dela Rosa argue that the ICC no longer has jurisdiction following the Philippines’ withdrawal from the Rome Statute in 2019.

Despite those arguments, government officials insist that international obligations and existing legal mechanisms allow cooperation with the ICC in this case.

As political and legal battles continue, attention remains focused on whether authorities will successfully locate and arrest the senator in the coming days.
