A former Ohio attorney has been convicted of attempted murder after prosecutors said he confronted his ex-wife with a loaded handgun at a Toledo restaurant and attempted to shoot her.
Matthew Exton, 43, was found guilty by a Lucas County jury of attempted murder, two counts of felonious assault and multiple firearm specifications. He was acquitted of another felonious assault charge.
The incident happened on April 11, 2025, at a restaurant in downtown Toledo, where Exton’s former wife was dining with members of her family.
Gun Failed to Fire During Restaurant Attack
According to prosecutors, Exton encountered his ex-wife while leaving a nearby restaurant. He initially ordered a drink and had it delivered to the table where she was sitting with her family. He then left the restaurant.
Prosecutors said Exton returned later carrying a handgun and walked toward his former wife’s table. He allegedly pointed the weapon at her and attempted to fire.
The gun did not discharge because its safety was still engaged.
The firearm was loaded, with one round in the chamber and seven additional rounds in the magazine, according to prosecutors.
Exton’s former wife later told authorities that he pointed the gun toward her chest and pulled the trigger several times, producing a series of clicking sounds.
Waiter and Patrons Tackled the Gunman
Before Exton could make another attempt to fire the weapon, a restaurant waiter intervened. Other patrons also rushed to help, and they were able to tackle Exton and prevent the situation from escalating.
Prosecutors praised the restaurant employees and customers who stepped in during the confrontation, saying their actions helped prevent further violence.
Lucas County Prosecuting Attorney Julia Bates described the incident as an extremely dangerous attack and said the restaurant staff and patrons who intervened deserved recognition for their actions.
Exton Denied Trying to Kill His Ex-Wife
During his trial, Exton disputed prosecutors’ account of his intentions. He testified that he did not attempt to shoot or harm his former wife.
Exton said he had been frustrated over issues connected to his 2024 divorce and the handling of the former couple’s home. He claimed he displayed the firearm to emphasize that he wanted her to follow a court order and move more quickly with the sale of their former property.
He also testified about the difficulties he experienced following the divorce, including becoming homeless.
Despite his explanation, jurors convicted him of attempted murder and two counts of felonious assault, along with firearm specifications.
Exton’s law license was suspended by the Ohio Supreme Court following the 2025 incident.
He is scheduled to be sentenced on September 21, 2026, and could face up to 25 years in prison.
