Florida Man Faces Murder Charge in Infant Son’s Death
A 38-year-old Florida man has been charged with first-degree premeditated murder in connection with the death of his six-month-old son, nearly two years after the child died from severe injuries.
According to court records, James Westervelt of Ocala was already in custody on child abuse charges linked to the same case. Prosecutors have now upgraded the charges after additional evidence and statements gathered during the investigation.
The infant died in August 2024 after being hospitalized with serious injuries. Medical findings determined the cause of death was blunt force trauma consistent with violent shaking or forceful bouncing, investigators said.
Investigators Describe Pattern of Alleged Child Abuse
Authorities began investigating after emergency responders were called to the family’s home when the baby was found unresponsive.
During the investigation, detectives reportedly discovered video evidence showing an earlier incident in which Westervelt allegedly used a leaf blower on the infant. Investigators said the suspect later admitted he carried out the act because he believed it was “funny.”
Officials emphasized that the murder allegation is based on the broader abuse investigation and the fatal injuries sustained by the child, not solely on the earlier leaf blower incident.
Charges Upgraded Following New Evidence
Westervelt was initially arrested on child abuse charges before prosecutors sought a first-degree murder indictment as the investigation progressed. Authorities said conflicting statements and additional evidence contributed to the decision to pursue the more serious charge.
He remains in custody and is expected to appear in court in September, where the murder case will continue through the legal process. As with all criminal cases, the charges are allegations, and the defendant is presumed innocent unless proven guilty in court.
