Federal Court Suspends Key Provisions of Philadelphia’s ‘ICE Out’ Law

A federal judge has issued a preliminary injunction preventing Philadelphia from enforcing major parts of its recently approved “ICE Out” legislation, which sought to restrict federal law enforcement officers from wearing face coverings while carrying out operations in the city.

The ruling pauses the law before it was scheduled to take effect, marking another significant legal development in the nationwide debate over immigration enforcement practices and the authority of local governments to regulate federal agencies.

Judge Says City Cannot Control Federal Enforcement Operations

U.S. District Judge Chad Kenney ruled that Philadelphia is unlikely to have the legal authority to dictate how federal officers perform their duties. According to the court, the U.S. Constitution prevents cities and states from imposing operational requirements on federal agencies.

The challenged provisions of the “ICE Out” law would have:

  • Prohibited federal officers from wearing masks or concealing their identities during enforcement actions.
  • Required visible badges or identifying information.
  • Mandated the use of clearly marked government vehicles.
  • Allowed civil and criminal penalties for violations.

In his decision, Judge Kenney concluded that allowing municipalities to establish their own rules for federal officers could interfere with the federal government’s ability to carry out its responsibilities consistently across the country.

Trump Administration Argued Officer Safety Was at Risk

The lawsuit was brought by the Trump administration, which argued that forcing federal officers to reveal their identities could place agents at greater personal risk, compromise undercover assignments, and disrupt ongoing investigations.

Philadelphia officials maintained that the ordinance included exceptions allowing masks during undercover and surveillance operations. However, the court determined that the city still lacked authority to regulate federal law enforcement procedures.

Part of a Growing National Legal Battle

The Philadelphia case is one of several legal disputes involving state and local efforts to regulate the use of masks by federal law enforcement officers, particularly those involved in immigration enforcement.

Federal courts have recently blocked similar measures in other states, while additional legal challenges continue over laws that seek to limit how federal officers conduct immigration-related operations.

The preliminary injunction means Philadelphia cannot enforce the contested sections of the “ICE Out” law while the lawsuit proceeds through the federal court system.
