Family Sues Philadelphia Over Andrew Drury’s Jail Death
The family of Andrew Drury has filed a lawsuit against the City of Philadelphia following his death in custody at the Curran-Fromhold Correctional Facility (CFCF). The legal action, initiated in early 2026, alleges that the 42-year-old man died due to medical neglect and a failure to provide adequate supervision during his detention in March 2025.
According to the lawsuit, Drury was arrested on bench warrants in the Kensington neighborhood and subsequently transferred to the Northeast Philadelphia jail complex. Records obtained during the investigation indicate that intake staff had flagged Drury as an “emergency” case due to his history of substance use and visible signs of distress. Despite this classification, which typically mandates one-on-one observation, the complaint asserts that Drury was left unmonitored in a holding cell for an extended period. He was later found unresponsive in the intake room. Although correctional officers administered Narcan and attempted other lifesaving measures, he could not be revived and was pronounced dead at the scene.
The family contends that Drury’s death was preventable, attributing it to severe withdrawal symptoms that went untreated. “He should have received immediate medical evaluation and constant monitoring given his condition,” a representative for the family stated in court filings. They argue that the jail’s failure to adhere to its own medical protocols directly contributed to his fatal cardiac event.
In response to the filing, a spokesperson for the Philadelphia Department of Prisons declined to comment on pending litigation. City officials have previously maintained that they are committed to inmate safety and are working to address operational challenges within the prison system. Attorneys for the city are expected to file a response detailing their defense, which often includes arguments regarding governmental immunity or adherence to available resources during intake procedures.
This lawsuit is the latest in a series of legal challenges facing the Philadelphia Department of Prisons. The system has been under intense scrutiny for years due to chronic staffing shortages, facility lockdowns, and allegations of inadequate medical care. In late 2024, the family of Louis Jung Jr. filed a similar federal lawsuit after he died from diabetic ketoacidosis while in custody, further highlighting systemic concerns regarding the health management of detainees with chronic conditions.
Federal monitors and civil rights advocates have repeatedly warned about dangerous conditions inside Philadelphia’s jails. A court-appointed monitor recently reported that the staffing crisis has led to delayed medical responses and insufficient supervision of vulnerable inmates. The Drury family’s lawsuit seeks unspecified damages and calls for reforms to ensure that detainees flagged for medical emergencies receive immediate and appropriate care.
