The family has filed a lawsuit claiming that school staff ignored warnings, allowing the abuse to continue. According to the complaint filed in November, the boy was assaulted multiple times during the 2023–2024 school year at Wake Forest Magnet Elementary School. The accusations describe incidents in a school bathroom where the classmate allegedly touched and fondled the victim, among other abusive acts.
Despite being informed, neither a teacher nor the school principal took effective steps to stop the assault. The lawsuit claims that even after the child reported the abuse and later his mother informed the principal, no protective measures were put in place — and the perpetrator was not removed from the same class.

The legal filing states that the boy has suffered “severe mental and emotional injuries,” including anxiety, trauma, and a diminished capacity to enjoy life. The family is seeking monetary damages from the district — demanding more than US$25,000.
