HOUSTON — A family has filed a civil lawsuit as criminal charges move forward against a former stadium employee accused of inappropriate conduct involving an 8-year-old boy inside a men’s restroom at NRG Stadium during a December NFL game. The accused worker is now in custody and faces serious felony charges in connection with the alleged incident.


Former Stadium Staff Arrested After Alleged Restroom Incident

Officials say 21-year-old Ushay Marquise Nixon, who was working as a restroom attendant during the December 14 game between the Houston Texans and Arizona Cardinals, has been charged with indecency with a child and attempted aggravated sexual assault of a minor. According to Texas court records, the boy’s family claims Nixon directed the child into a locked bathroom stall and pulled down his pants before the child escaped and ran back to his parents.

Surveillance footage allegedly shows a man fitting the description of Nixon entering and exiting the restroom around the time of the incident, and the child later identified the suspect before police took him into custody at the stadium.


Legal Action and Harrowing Aftermath for Family

In addition to the criminal case, the boy’s parents have filed a lawsuit in Harris County alleging negligence by Nixon’s employer and the stadium operator for failing to ensure guest safety. The complaint accuses the employer of inadequate background screening and supervision that put the child at risk.

The family’s attorney has said the lawsuit seeks accountability and change in safety protocols at large public venues. The boy’s parents have also described the emotional toll the incident has had on their child, including nightmares and distress.


Employer Response and Ongoing Investigation

Representatives for the vendor confirmed the accused is no longer employed and that they are cooperating with law enforcement. The stadium operator has not publicly detailed changes to its staffing or safety procedures but asserts guest security remains a priority. Houston police are urging witnesses or anyone with additional information to contact the department’s Special Victims Unit.
