A newly circulated draft of prosecutorial guidance in England and Wales recommends classifying male circumcision as a possible form of child abuse in specific harmful or unsafe cases. The Crown Prosecution Service (CPS) document groups the practice with other “harmful practices,” raising alarm and debate across religious, medical, and human rights communities. The proposal does not make circumcision illegal by default, but highlights situations where dangerous or inappropriate procedures might be treated as criminal offenses.


Why This Draft Guidance Has Sparked Controversy

The draft guidance arrives amid concern from coroners and legal figures about a number of tragic incidents where boys have died or suffered serious harm after circumcisions performed outside regulated clinical settings. At least seven deaths of boys under 18 have been linked to circumcision procedures since 2001, including bleeding and infections.

Religious leaders — particularly from Jewish and Muslim communities — have strongly rejected the idea that the practice itself ought to be seen as abusive. These groups emphasize that when performed safely and respectfully, circumcision is a lawful and deeply significant religious and cultural rite. They propose improved safety standards and accreditation systems instead of reframing the procedure under child abuse policy.


Reactions from Medical, Rights and Community Groups

Medical professionals and secular advocates argue there is no medical necessity for routine infant circumcision, and that risks to children warrant more stringent oversight or proposals that the decision be made when individuals can consent for themselves. Some experts argue that procedures lacking clear medical benefits should be postponed until a boy can agree to it.

Meanwhile, community health advocates say better information and safeguarding practices are essential, especially in areas where access to credible medical support and education is limited. Discussions now focus on whether national regulation or practitioner licensing could protect children without infringing on cultural or religious freedoms.
