NYC Mayor Clarifies City’s Legal Limits on Netanyahu Arrest

New York City Mayor Zohran Mamdani has acknowledged that his administration does not have the legal authority to arrest Israeli Prime Minister Benjamin Netanyahu if he visits the city, despite earlier remarks supporting enforcement of the International Criminal Court (ICC) arrest warrant.

Speaking in a video statement, Mamdani said his legal team thoroughly reviewed the issue and concluded that any action involving the ICC warrant falls under the jurisdiction of the U.S. federal government rather than municipal authorities. While reaffirming his criticism of Netanyahu, he emphasized that New York City cannot independently carry out such an arrest.


Mayor Urges Federal Government to Enforce ICC Warrant

Although he acknowledged the city’s legal limitations, Mamdani urged federal officials to honor the ICC warrant should Netanyahu travel to the United States. He described the Israeli leader as a war criminal and stated that he does not believe Netanyahu should be welcomed in New York City.

The ICC issued arrest warrants in 2024 for Netanyahu and former Israeli Defense Minister Yoav Gallant over alleged war crimes connected to the Gaza conflict. Israeli officials have strongly rejected the accusations, while the United States is not a member of the ICC and does not recognize the court’s jurisdiction.


Trump and Israeli Officials Push Back

President Donald Trump dismissed the possibility of Netanyahu being arrested during a visit to the United States, stating that the Israeli prime minister would not face detention on American soil. Israeli officials also criticized Mamdani’s comments, arguing that his position could create unnecessary diplomatic tensions.

The issue has sparked a broader debate over the relationship between international law and U.S. domestic authority, with legal experts noting that decisions involving foreign leaders and international treaties remain the responsibility of the federal government rather than local officials.
