Daniel and Lynn Rae Wentworth, a couple who purchased a historic home in Beaver County, Pennsylvania, in September 2023, have filed a lawsuit against the property’s previous owner after uncovering hate symbols permanently tiled into the basement floor. The couple discovered a large swastika and a German Reichsadler (Imperial Eagle) hidden beneath rugs and furniture shortly after moving into the residence.
According to court documents, the Wentworths allege that the seller, who emigrated from Germany after World War II, knowingly concealed the designs during the home inspection process. The plaintiffs claim the imagery, which spans nearly six feet in diameter, constitutes a “material defect” that significantly devalues the property and causes emotional distress. They are seeking damages to cover the cost of removing the tile and replacing the flooring.
The legal dispute centers on whether hateful iconography qualifies as a physical defect requiring disclosure under Pennsylvania real estate law. While the plaintiffs argue the symbols are a permanent, material flaw comparable to structural damage, the defense has suggested the imagery is cosmetic and does not impact the home’s habitability or function. The seller has reportedly claimed the design was installed in the 1970s and intended to represent ancient symbols of good fortune rather than hate speech, a defense the current owners reject given the accompanying German eagle.
Real estate legal experts note that while material defects typically refer to issues like a leaking roof or faulty foundation, this case tests the boundaries of disclosure regarding “psychological defects” or vandalism that carries historical stigma. The lawsuit remains ongoing as courts determine if the undisclosed presence of such symbols violates the seller’s duty to the buyer.
