Eight months after legal proceedings commenced, Carlos appeared in a St. Thomas courthouse to face federal charges of illegal reentry into the United States. Following a two-day trial, a jury returned a verdict of not guilty, a decision driven largely by an overwhelming display of support from his community in Pennsylvania.
The prosecution’s case rested on the technical components of federal immigration law, which strictly prohibits individuals who have been deported or removed from re-entering the country without government authorization. Prosecutors maintained that the violation was a clear-cut statutory offense, arguing that the integrity of the immigration system depends on the consistent enforcement of border laws, regardless of a defendant’s personal character or community standing. From a legal standpoint, the government emphasized that the presence of the accused on U.S. soil without permission constituted the crime, irrespective of his reasons or relationships.
However, the defense presented a narrative that extended beyond the technical boundaries of the statute. The proceedings were marked by the presence of twenty friends and supporters who had flown in from Pennsylvania to stand with Carlos. Additionally, the defense submitted 200 letters from community members attesting to his character and contributions.
While juries are generally instructed to apply the law to the facts, the sheer volume of character evidence appears to have played a decisive role in the deliberation room. The visible support in the gallery and the written testimonials successfully countered the prosecution’s argument, leading the jury to reject the charges and acquit Carlos of the illegal reentry offense.
