Authorities in Atlanta have charged 37-year-old Omayrilin Colon with murder and first-degree cruelty to children after her 2-month-old son died from lethal alcohol ingestion. The arrest follows a months-long investigation that began in October when police and paramedics responded to a report of an unresponsive infant at an apartment on Perry Boulevard. The child was rushed to Children’s Healthcare of Atlanta at Scottish Rite but was pronounced dead shortly after arrival.
According to court documents released during Colon’s recent bond hearing, toxicology reports revealed the infant had a blood-alcohol concentration of .179. This level is more than double the legal limit for an adult driver in Georgia. While early inquiries often consider accidental transfer, medical examiners concluded that the alcohol was not passed through breast milk but was directly ingested from a baby bottle. Investigators allege that the alcohol was intentionally placed in the formula, leading to the fatal poisoning.
Colon waived her first appearance in court and was denied bond by the presiding judge. While the public defender representing Colon declined to issue an immediate statement, legal experts note that the defense will likely challenge the prosecution’s assertion of “intent.” In similar cases involving infant deaths, defense teams often argue that such incidents are tragic accidents resulting from a lack of knowledge or negligence rather than malice murder, requiring the state to prove beyond a reasonable doubt that the mother knowingly sought to harm the child.
The delay between the October incident and the recent charges is attributed to the time required for comprehensive autopsy and toxicology results. Medical experts warn that infants have zero tolerance for alcohol; even minute amounts can lead to hypoglycemia, seizures, coma, and death because their immature livers cannot process the toxin. Colon remains held in the Fulton County Jail as the legal proceedings move forward.
