PROVO, Utah — The man accused of fatally shooting conservative activist Charlie Kirk will stand trial on aggravated murder and other charges after a Utah judge ruled that prosecutors presented enough evidence for the case to move forward.

Tyler Robinson, 23, pleaded not guilty following the court’s decision. The aggravated murder charge means he could face the death penalty if convicted.

Judge Finds Enough Evidence for Trial

Utah District Judge Tony Graf ruled that the evidence presented during the preliminary proceedings was sufficient to send Robinson’s case to trial.

Prosecutors allege that Robinson fatally shot Kirk during an event at Utah Valley University in September 2025. They have pointed to evidence including video footage, DNA and other material they say connects Robinson to the shooting.

The defense challenged the evidence and argued against allowing the case to proceed as a capital murder prosecution.

Death Penalty Remains an Option

A major issue before the court was whether the alleged shooting created a serious risk to other people nearby, an aggravating factor that could make Robinson eligible for capital punishment under Utah law.

Prosecutors argued that the shooting occurred in the presence of a large crowd and put others at risk. Robinson’s lawyers maintained that Kirk was the intended target and disputed the claim that the circumstances justified a potential death sentence.

Judge Graf ultimately allowed the aggravated murder charge to remain in place, keeping the possibility of the death penalty open if Robinson is convicted.

Family Calls Ruling a Step Toward Justice

Kirk was killed while speaking at an event at Utah Valley University, an incident that drew national attention and renewed concerns about political violence in the United States.

Robinson turned himself in following the shooting and now faces trial after entering not guilty pleas to the charges against him. A future hearing is expected as the court moves toward setting the next stages of the high-profile case.
