Taiwan Prosecutors Seek OnePlus CEO in Illegal Recruitment Case

Taipei prosecutors have issued a formal arrest warrant for OnePlus chief executive Pete Lau on allegations of illegally hiring Taiwanese engineers without required government permission, marking a significant move in Taiwan’s efforts to enforce laws governing foreign business activity. The Shilin District Prosecutors Office also indicted two Taiwanese nationals for assisting in the recruitment of more than 70 local tech workers purportedly for mobile software research and testing.

Taiwan’s regulations strictly limit how mainland Chinese firms operate and hire on the island, designed to safeguard sensitive technology sectors such as semiconductors and software development. Prosecutors say the alleged hires violated the Act Governing Relations Between the People of the Taiwan Area and the Mainland Area, which mandates formal approval before Chinese companies can recruit or conduct business locally.

Details of the Alleged Scheme and Legal Charges

According to legal filings, OnePlus is accused of establishing recruitment operations in Taiwan without prior authorization, allegedly using intermediary arrangements to bring in over 70 engineers tasked with research and development, verification, and software testing. The recruitment activities are said to have taken place over several years, drawing scrutiny from Taiwanese authorities concerned about illicit talent acquisition by foreign tech firms.

The two Taiwanese individuals named in the indictment are accused of facilitating the hiring process and helping to manage the local operations connected to the alleged scheme. Prosecutors classify these actions as violations of cross-strait business laws that govern how mainland Chinese companies engage with Taiwan’s workforce and technology ecosystem.

Broader Context: Taiwan’s Crackdown on Unauthorized Hiring

This legal action comes amid a broader enforcement campaign by Taiwan to prevent unauthorized recruitment by foreign technology companies, particularly from mainland China. Taiwan has previously investigated multiple Chinese firms for hiring local engineers and has stepped up oversight of hiring practices in sectors deemed strategically important.

Officials emphasize that protecting domestic tech talent is critical not only for economic competitiveness but also for national security, given Taiwan’s leading role in global technology industries. The case against Pete Lau and OnePlus underscores the increasing regulatory pressure on foreign companies to comply with Taiwan’s legal framework for cross-strait economic activities.
