Immigration arrests across the United States have climbed sharply in recent months, but the rise has not translated into a similar increase in deportations. Preliminary government figures show that Immigration and Customs Enforcement (ICE) recorded nearly 51,000 arrests in August, while daily deportations remained broadly stable at around 1,200.

The widening gap highlights the legal and logistical challenges facing President Donald Trump’s administration as it pushes for a major expansion of immigration enforcement. Pending asylum cases, unresolved immigration proceedings, and limited deportation capacity are among the factors slowing the removal process

ICE Arrests Rise as Immigration Enforcement Expands

The latest increase in arrests follows a broader expansion of immigration enforcement operations across the country. Federal immigration officers have worked more closely with local police, increased the use of technology, and relied on information-sharing systems to identify and apprehend people suspected of violating immigration rules.

The August total marked a third consecutive monthly record, according to preliminary figures. By comparison, arrests in May were approximately 19,000 lower, yet the average number of daily deportations was similar.

The figures suggest that a rise in arrests does not automatically produce a matching increase in removals.

Pending Legal Cases Make Deportations More Difficult

One major reason for the difference is the immigration status of those being detained. A growing share of arrests involves people who do not have criminal convictions or final deportation orders.

Some detainees have pending asylum applications, family-sponsored green card petitions, or other legal claims that may allow them to remain in the country while their cases are reviewed. These proceedings can prevent immediate removal unless the individual gives up applicable rights and agrees to leave voluntarily.

Immigration officials have also detained people who previously shared personal information with government agencies while seeking legal status. This includes individuals with family-based immigration applications and people whose temporary protections have been revoked.

The administration has said it is focused on dangerous offenders. However, figures from the Deportation Data Project indicate that people with criminal convictions accounted for less than one-quarter of arrests in July, compared with nearly 60% in December 2024

Deportation Flights and International Restrictions Add to Delays

Even when an individual is eligible for deportation, arranging their removal can be complicated. ICE must coordinate transportation, detention transfers, and acceptance by the destination country.

Former immigration officials have pointed to the availability of deportation flights as a significant limitation. Aircraft may leave with empty seats because of legal, diplomatic, or operational constraints, while some countries restrict the number of people they will accept.

The Trump administration agreed last year to purchase six Boeing 737 aircraft for deportation operations. However, the planes were still undergoing Federal Aviation Administration checks and had not entered service, according to information reported in September.

Recent flights to Cap-Haïtien in Haiti carried as few as 57 people, illustrating how transportation limitations can affect the pace of removals.
